An affidavit sworn by Mark Anthony Ryan, the Assistant Federal Secretary of the Media Entertainment and Arts Alliance on 23 May 2005 was later filed. 3 The new award came forward by consent of the parties, they submitting that it complied with the requirements of the Industrial Relations Act 1996 and the Commission's applicable principles. 4 Having considered the terms of the application, the supporting affidavit and the submissions of the parties, I am satisfied that the requirements of the Act and the applicable principles are satisfied and that it is accordingly appropriate that the Commission's discretion to make a new award in the agreed terms be exercised. 5 For those reasons, I make the award in terms of the application.
