Clause 1
Short title
This Act may be cited as the Fluoridation of Public Water
Supplies Amendment Act 2004.

This part amends the Fluoridation of Public Water Supplies
Act 1963.
Amendment of s 2 (Interpretation)
Section 2—
insert—
'controlling entity, for a public water supply, means—
(a) if the public water supply is under the control of a local
government—the local government; or
(b) _ if the public water supply is under the control of another
entity—the other entity.'.

A controlling entity for a public water supply must add
fluorine, in a form prescribed under a regulation, to the public
water supply.
The controlling entity for a public water supply must maintain
the content of fluorine in the public water supply at a
concentration of not more than the maximum or less than the
minimum prescribed under a regulation.
However, subsections (1) and (2) do not apply to a controlling
entity for a public water supply if the public water supply is
used for supplying water to fewer than the number of persons
prescribed under a regulation.
A controlling entity for a public water supply must not add
fluorine to the public water supply, other than as provided by
this section.'.
