A BILL FOR An Act to amend the Gas Act 1965 Clause Clause Clause Clause Clause s1 4 s5 Gas Amendment Bill (No. 2) 2001 The Parliament of Queensland enacts— Short title This Act may be cited as the Gas Amendment Act (No. 2) 2001. Act amended This Act amends the Gas Act 1965. Amendment of s 2 (Relationship to prescribed Acts) (1) Section 2(2)— insert— '(ab)Gas Pipelines Access (Queensland) Law; or'. (2) Section 2(2)(ab) to (c)— renumber as section 2(2)(b) to (d). Amendment of s 5 (Definitions) (1) Section 5, definition "contestable consumer", 'section 5B'— omit, insert— 'section 33A'. (2) Section 5, definition "non-contestable consumer", 'section SC'— omit, insert— 'section 33B'. Relocation and renumbering of s 5B (Meaning of "'contestable consumer'') Section 5B— relocate and renumber, in part 5, as inserted by this Act, as section 33A. The registration and identification of, or access to, delivery points. 2. The provision of meters and telemetry equipment. 3. The nature and storage of information and the communication of, and access to, that information. 4. Gas nomination and balancing. 5. Consumer transfer processes. (b) impose stated terms on the arrangements; and (c) provide for the legal effect or enforcement of the terms, including, for example, by dispute resolution, arbitration or court proceedings. '(2) The regulation may apply, adopt or incorporate a code of conduct, or an amendment of a code of conduct, made by the Minister about the arrangements mentioned in subsection (1). '(3) The code, or amendment of the code, does not take effect unless it is approved under a regulation. '(4) In this section— "covered distribution pipeline" means a distribution pipeline within the meaning of the Gas Pipelines Access (Queensland) Law that is a covered pipeline within the meaning of that law. "transmission pipeline" means a transmission pipeline within the meaning of the Gas Pipelines Access (Queensland) Law.! '33F Tabling and inspection of code of conduct '(1) This section applies if, under section 33E(2), a regulation applies, adopts or incorporates a code of conduct, or an amendment of a code of conduct. 1 See the Gas Pipelines Access (Queensland) Law, schedule 1, section 2, definitions "distribution pipeline" and "transmission pipeline". For coverage under that law, see schedule 2 of the law, part 1 (Coverage) and section 10.8, definition "covered pipeline". CAN DMN FB WNK Com AND FWNY KF CO N Co NNW WN Nw ns 28 Clause Clause s10 7 s11 Gas Amendment Bill (No. 2) 2001 '(2) The Minister must, within 14 sitting days after the regulation is gazetted, table a copy of the code, or the amendment or amended code, in the Legislative Assembly. '(3) The Minister must keep a copy of the code, as in force from time to time, open for inspection, free of charge, by members of the public during office hours on business days at— (a) the department's head office; and (b) other places the Minister considers appropriate.
